"Report" refers to a one-off vehicle history report purchased through the Service.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Using the Service

4.1 No Account Required

Most features of the Service are available without registration. Where we introduce optional accounts in future, you agree to provide accurate information and to keep your credentials secure. You are responsible for all activity that occurs through your use of the Service.

4.2 Accurate Information

When you enter a vehicle registration mark (VRM) or other details, you agree to provide accurate information. You must only look up vehicles for lawful, personal purposes (see our Acceptable Use Policy).

4.3 Suspension of Access

We reserve the right to restrict, suspend, or terminate your access to the Service at any time, with or without notice, if you violate these Terms, engage in fraudulent or illegal activities, or where we are required to do so by law.

5. Service Description

5.1 Vehicle Guides and Tools

We provide honest, plain-English guides to used cars, an AI-powered car expert, a direct vehicle lookup, and a lifestyle matcher. These tools are informational and intended to help you research vehicles before purchase.

5.2 AI Car Expert

Our AI car expert provides general, automated guidance about used cars. Its responses are generated by a third-party AI model and may contain errors or omissions. AI responses do not constitute professional, mechanical, financial, or legal advice, and should not be relied upon as your sole basis for any decision.

5.3 Vehicle History Reports

We offer one-off vehicle history reports which may include data such as MOT history, tax status, mileage records, and outstanding finance or write-off/salvage markers. This information is sourced from third-party databases, including the UK Driver and Vehicle Licensing Agency (DVLA) and other authorized data providers. Reports are delivered digitally and are for personal, non-commercial use only.

5.4 Service Availability

We strive to provide uninterrupted Service but do not guarantee that the Service will be available at all times. We may suspend or discontinue any part of the Service without notice.

6. Payments

6.1 Pricing

Our vehicle history reports are sold on a one-off, pay-as-you-go basis. There are no subscriptions or recurring charges. The price for a report is displayed clearly before you complete your purchase. All prices are in British Pounds (GBP) and include applicable VAT.

6.2 Payment Processing

Payments are processed by our third-party payment processor, Stripe. We do not store your full payment card details. By making a purchase, you authorize us (via Stripe) to charge your chosen payment method for the amount displayed.

6.3 Delivery of Digital Content

Reports are digital content delivered as soon as your payment is confirmed. By purchasing, you request and consent to immediate delivery and acknowledge that this affects your statutory right to cancel (see our Refund and Cancellation Policy).

6.4 Refunds

Refunds are handled in accordance with our Refund and Cancellation Policy, which forms part of these Terms.

7. Acceptable Use

7.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy. You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems
  • Use automated systems (bots, scrapers) to access the Service
  • Resell or redistribute our data or reports without permission
  • Impersonate any person or entity
  • Use the Service to harass, track, or harm any individual

7.2 Data Use Restrictions

Vehicle data and reports provided through the Service are for personal, non-commercial use only. You may not:

  • Scrape, crawl, or systematically collect data from the Service
  • Create derivative databases from our data
  • Use vehicle data to identify, profile, or contact vehicle owners
  • Use data for marketing purposes without consent
  • Use data to compete with the Service

8. Intellectual Property

8.1 Our Rights

The Service and all Content, including but not limited to text, graphics, logos, software, and design, are owned by or licensed to Carters Clear Car and are protected by UK and international copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and any Report you purchase for personal, non-commercial purposes, subject to these Terms.

8.3 Restrictions

You may not:

  • Modify, copy, or redistribute Content or Reports from the Service
  • Reverse engineer or decompile any software
  • Remove or modify any copyright, trademark, or proprietary notices
  • Use our trademarks without written permission

9. Third-Party Services and Links

9.1 Third-Party Data and Providers

The Service relies on data and services from third-party sources, including:

  • UK DVLA (Driver and Vehicle Licensing Agency)
  • Authorized vehicle data providers
  • Google (AI model services)
  • Stripe (payment processing)

We are not responsible for the accuracy, completeness, or timeliness of third-party data.

The Service may contain links to third-party websites. We do not endorse or assume responsibility for third-party content. Your use of third-party websites is at your own risk and subject to their terms and conditions.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Data Accuracy

While we strive to provide accurate and up-to-date information, we do not warrant that:

  • Vehicle data is complete, accurate, or current
  • AI-generated guidance is accurate or free from error
  • The Service will be uninterrupted or error-free
  • Any errors will be corrected

10.3 Vehicle Purchases

IMPORTANT: The Service provides historical data and general guidance only. We strongly recommend that you:

  • Conduct a physical inspection before purchasing any vehicle
  • Obtain a professional mechanical inspection
  • Verify all information independently
  • Do not rely solely on our reports or AI guidance for purchasing decisions

We are not responsible for any losses arising from vehicle purchases made in reliance on data or guidance provided through the Service.

10.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARTERS CLEAR CAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or other harmful code
  • Any errors or omissions in Content or Reports
  • Any third-party content or conduct

10.5 Maximum Liability

In no event shall our total liability to you for all damages exceed the amount paid by you to us in the twelve (12) months preceding the claim, or £100, whichever is greater.

10.6 Consumer Rights Preserved

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded or limited under applicable law. If you are a consumer, you have statutory rights under the Consumer Rights Act 2015 and other UK consumer legislation that are not affected by these Terms.

You agree to indemnify, defend, and hold harmless Carters Clear Car, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

12. Data Protection and Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

14. Termination

14.1 By You

You may stop using the Service at any time. Because reports are one-off purchases, there is nothing to cancel other than to discontinue use.

14.2 By Us

We may terminate or suspend your access immediately, without prior notice, if:

  • You breach these Terms or our Acceptable Use Policy
  • You engage in fraudulent or illegal activities
  • We are required to do so by law
  • We decide to discontinue the Service

14.3 Effect of Termination

Provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

15.2 Jurisdiction

Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.3 Informal Resolution

Before filing a formal claim, you agree to contact us at legal@cartersclearcar.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Refund and Cancellation Policy, and Acceptable Use Policy, constitute the entire agreement between you and Carters Clear Car regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, labour disputes, or government actions.
